I. scope

these terms and conditions apply to all orders placed via the online shop of archivio di dio.

a consumer is any natural person acting for purposes outside their trade, business or profession. a business is any natural or legal person acting in the course of their commercial or independent professional activity.

II. conclusion of contract

the presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue.

by placing an order, you submit a binding offer to purchase the selected product.

the contract is concluded when we accept your order by sending an order confirmation via email.

before submitting your order, you can review and correct your entries at any time.

III. prices and payment

all prices are stated in euros and include statutory value-added tax (VAT), unless otherwise stated.

shipping costs are shown separately during checkout.

payment is due immediately upon conclusion of the contract.

IV. delivery conditions

delivery times and shipping costs are indicated during the ordering process.

products may be shipped either by archivio di dio or directly by the respective collaborator.

for deliveries outside the european union, additional customs duties, taxes or fees may apply, which are to be borne by the customer.

the risk of accidental loss or deterioration of the goods passes to the consumer upon delivery.

V. right of withdrawal

VI. returns

unless otherwise agreed, the customer bears the direct costs of returning the goods.

returns must be sent to the address provided after confirmation of the return request.

the right of withdrawal does not apply to:
— goods made to order
— clearly personalised products
— sealed goods not suitable for return for health or hygiene reasons if unsealed

IX. liability

we are liable without limitation for intent and gross negligence.

in cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to foreseeable damage.

we are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

XI. applicable law

the law of the federal republic of germany applies, excluding the UN convention on contracts for the international sale of goods.

for consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their country of residence.
